No Alcohol and Drugs Law and Conditions in Commercial Vehicles
YOURNZDRIVER Terms, Conditions and the NZ Law
Luxury Vehicle and Driver Safety/Laws
It is NZ law for all passengers including driver to be wearing a seatbelt. No alcohol or food permitted in vehicles unless otherwise agreed upon (dependent on the nature of the booking and the client requesting at time of booking). No drugs, smoking or vaping in vehicles.
Any damage to the vehicles will be added as a surcharge and client/agent will be notified immediately. Any abusive behaviour towards driver or causing driver unecessary pressure will not be tolerated.
Consuming Alcohol while in a Commercial/Passenger Vehicle
The NZ Legislation states It is illegal to consume alcohol in a vehicle that is operating as part of a commercial passenger service. This includes taxis, Ubers, buses, and limousines unless the operator has a special license. The driver or company has a right to say no or refuse to take the passenger(s) or a group. We also DO NOT hold a liquor licence.
If the inside of the vehicle is left in a dirty/soiled manner, then a cleaning fee of $250.00 will be charged to the hirer.
Smoking or the consumption of drugs and alcohol is not permitted in the vehicle at any time. Failure to comply may result in the termination of hire. Violation will result in the immediate termination of the contract and the forfeiture of all paid deposits and fees.
Alcohol is not to be consumed by any passenger in our vehicles, or our service will be terminated immediately and no refund will be given.
Irresponsible, dangerous or intoxicated behaviour, which compromises the safety of the chauffeur or passengers will not be accepted and may result in the termination of hire, without any refund.
The person reserving the vehicle is responsible for all guests and any damage to the interior and equipment in the vehicle and willful damage to the exterior. All passengers agree to behave in an orderly and well-behaved manner. This includes, but is not limited to: liquid spillage, vomiting, breakage of glassware ($10.00 each), lights, electronic and stereo equipment. Repair and replacement of any item will be the responsibility of the person hiring the vehicle. Executive Limousines reserves the right to expel any person from the vehicle and/or terminate this contract in the event of violation of any of these conditions by any passenger. In the event of such early termination the person reserving the vehicle, remains liable for the full rental fee, this will happen without any refund.
New Zealand Driving Laws
Our private driver or guides are required to take adequate breaks in-between their long driving days and hours. The maximum a driver can drive in any one day is 13 hours, with a minimum of 2x 30 minute breaks.
Deposits and Final Payments
To confirm a Multi-Day booking, you will be required to pay a 20% non-refundable deposit unless cancellation occurs due to a serious nature, we are happy to discuss at our discretion. If the confirmation of booking is within 2 months of travel full payment is required to confirm.
Prices are valid for payment by credit card (Visa, Amex, JCB or Mastercard) or bank deposit. If paying by credit or debit card a 3.4% fee applies. The amount received by YourNZDriver must be the correct amount invoiced for in New Zealand dollars. YourNZDriver is not responsible for bank fees that have not been taken in to account or loss due to exchange rate. Any shortfall of payment due to exchange rate or bank fees is the responsibility of the tour guest or group. Final documents will not be issued until full payment is made and cleared funds are received.
Final Group Numbers
Final group numbers must be confirmed 24 hours prior to booking start time. If you have passenger numbers more than what the vehicle can legally seat, your extra passengers must find their own way to dropoff address.
Cancellation Policy
YOURNZDRIVER reserves the right to make changes to their itineraries or cancel any trip, including a guaranteed trip, at any time prior to departure if something beyond the control of YOURNZDRIVER deems it necessary; including natural disasters, political instability, terrorism, weather, cultural conditions or other external events.
Accident Compensation Commission (ACC)
If you are injured whilst in New Zealand, ACC may be able to help with the cost of the treatment and support you need whilst you’re here. However, it is important to be aware that you cannot sue for personal injury – ACC replaces that right. Furthermore, ACC only covers treatment and rehabilitation costs whilst in New Zealand; it is not a replacement for travel insurance and does not cover illness, disrupted travel plans or emergency travel to get you back home.
Tour Guest Safety and Responsibility
At all times the decision of YourNZDriver / Private Driver, or any supplier representative decisions during your booking, will be final on all matters regarding safety and wellbeing of the guests and operational requirements of your booking. By travelling with YourNZDriver, the guests agree to abide by the authority of the YourNZDriver / Private Driver, or optional supplier.
Should the guest(s) fail to comply with the above or commit any illegal act when on the booking or, if in the opinion of YourNZDriver / Private Driver (in their sole discretion), the guest’s behaviour is abusive and is causing or is likely to cause danger, distress or material annoyance to others, YourNZDriver will terminate that client’s travel arrangements immediately without any liability on YourNZDriver's part or any third party agencies. The client will not be entitled to any refund for unused or missed services or costs incurred resulting from the termination of the travel arrangements, including, without limitation, return travel, accommodations, meals, and/or incidentals to YourNZDriver / Private Driver and will be responsible for any costs incurred by YourNZDriver or YourNZDriver’s suppliers as a result of damage, destruction, theft, or excess cleaning fees related to being sick in the luxury vehicle etc.
Child Carseats and Restraints
The only exception to the law is in a Commercial vehicle where it is not the responsibility of the driver to provide carseats. Especially in a vintage car or older model of vehicle is used where ISOFIX is not available.
Important Information Exclusion of Liability
1. Whilst YOURNZDRIVER will take all reasonable steps to provide an enjoyable tour, it accepts no liability for any loss of enjoyment experienced by passengers due to circumstances beyond its control. These circumstances include any condition, medical or otherwise, or treatment thereof, experienced either pre tour or during the tour. YOURNZDRIVER further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the Fair Trading Act 1986, and nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.
