Terms of Service

Effective date: September 2026

These Terms of Service (“Terms”) apply to Services provided by YOURNZDRIVER LIMITED, trading as YourNZDriver (“YourNZDriver”, “we”, “us” or “our”).


1. Your Agreement With Us

1.1

These Terms apply whenever you instruct us to provide or arrange Services for you.

Your contract with us consists of:

  • these Terms;
  • your quotation, itinerary, invoice or Booking Confirmation;
  • any booking-specific conditions provided to you before confirmation; and
  • where applicable, relevant third-party Supplier conditions.

Together these documents form the agreement between you and YOURNZDRIVER LIMITED.

1.2

A booking is accepted when you do one or more of the following:

  • accept our Booking Confirmation in writing;
  • instruct us to proceed;
  • make the Initial Booking Payment or full payment; or
  • otherwise clearly confirm that you wish us to provide the Services.

1.3

If a Booking Confirmation contains a booking-specific condition that differs from these standard Terms, the booking-specific condition will apply to that booking provided it was disclosed before confirmation.

We will not retrospectively impose more restrictive conditions on a confirmed booking.


2. Our Services

YourNZDriver provides private passenger transport and related New Zealand travel services.

Our Services may include:

  • airport, hotel, cruise-terminal and point-to-point transfers;
  • long-distance transfers;
  • private chauffeur and hourly charter services;
  • private day tours;
  • shore excursions;
  • multi-day private touring;
  • corporate, event, conference and group transport;
  • wedding transport;
  • transport planning and coordination;
  • itinerary planning connected with a YourNZDriver journey;
  • accommodation, activity, attraction, guide, restaurant, ferry and experience reservations;
  • vehicle and driver coordination;
  • meet-and-greet services; and
  • other travel-related Services agreed with you in writing.

Not every Service is provided directly by YourNZDriver. We may use approved drivers, vehicle operators, accommodation providers, attractions, guides and other third-party Suppliers.


3. Booking and Confirmation

3.1 Booking requests

A quotation, proposal or itinerary is subject to availability until the booking has been confirmed.

We may decline a booking request where we are unable to provide the Service safely, lawfully or to the standard reasonably expected of YourNZDriver.

3.2 When a booking becomes confirmed

Unless we agree otherwise in writing, a booking is not confirmed until:

  • we have issued a Booking Confirmation;
  • you have accepted it; and
  • the required Initial Booking Payment or full payment has been received in cleared funds.

Supplier availability is not guaranteed until the relevant Supplier reservation has also been secured.

3.3 Checking your booking

You are responsible for checking the Booking Confirmation carefully.

Please check, where relevant:

  • passenger numbers;
  • dates and times;
  • pickup and drop-off locations;
  • flight or cruise details;
  • vehicle category;
  • itinerary;
  • luggage requirements;
  • golf clubs or oversized equipment;
  • child-restraint requirements;
  • accessibility or mobility requirements; and
  • any other special arrangements.

Please notify us promptly if anything is incorrect.


4. Travel Agents, Companies and Group Organisers

4.1 Who is responsible for the booking

Where a travel agent, company, event organiser, tour organiser or other organisation makes a booking with YourNZDriver, that person or organisation will be treated as the Booking Client and will be responsible for the booking and all amounts due unless we expressly agree in writing that another person is the contracting client.

4.2 Payment responsibility

A Booking Client's obligation to pay YourNZDriver is not dependent on whether that Booking Client has received payment from its own customer, passenger, traveller or other third party.

Amounts properly due to YourNZDriver remain payable by the Booking Client.

4.3 Passenger information and conditions

The Booking Client is responsible for:

  • providing accurate passenger and itinerary information;
  • ensuring passengers are aware of relevant travel and conduct conditions;
  • communicating our alcohol, smoking, safety, luggage and passenger-behaviour requirements;
  • advising us of material changes; and
  • obtaining appropriate authority to provide passenger information to us for the purposes of delivering the booking.

Passengers must comply with these Terms while receiving our Services.


5. Third-Party Suppliers

5.1

Depending on the Service, YourNZDriver may act in different capacities.

We may act:

  • As agent — where we arrange a Supplier Service on your behalf and your contract for that Service is with the Supplier.
  • As coordinator or facilitator — where we recommend, arrange or coordinate a Supplier but you contract directly with that Supplier.
  • As principal — where YourNZDriver contracts with the Supplier or subcontractor and provides or packages that Service to you as part of our own booking.

Different arrangements may apply to different parts of the same itinerary.

5.2 Supplier conditions

Supplier Services may be subject to the Supplier's own:

  • cancellation conditions;
  • payment requirements;
  • minimum stays;
  • change conditions;
  • weather policies;
  • age or accessibility requirements; and
  • other operating conditions.

Where those conditions materially affect your booking, we will endeavour to make them available or explain them to you.

5.3

Where we act only as your agent or coordinator, we are responsible for exercising reasonable care and skill in arranging the Service but are not responsible for a Supplier's independent performance of its own contract.

Where we act as principal, we remain responsible for our own obligations to you notwithstanding that we may use a subcontractor or Supplier.


6. Pricing and Payment

6.1 Prices

Unless stated otherwise:

  • prices are in New Zealand dollars; and
  • prices quoted to consumers include GST.

Your Booking Confirmation will set out the price payable for the agreed Services (“Booking Price”).

6.2 Planning Fee

Where a Planning Fee applies, it will be advised before planning work begins.

A Planning Fee becomes non-refundable to the extent that the agreed planning work has commenced or been performed.

If you proceed with a confirmed journey, YourNZDriver may agree to credit some or all of the Planning Fee against the Booking Price.

A credit towards the later booking does not make planning work already completed refundable if the journey is subsequently cancelled.

6.3 Initial Booking Payment

An Initial Booking Payment of at least 30% of the Booking Price will ordinarily be required.

The amount may be higher depending on the requirements of the booking.

For example, an Initial Booking Payment of 50% or another amount may be required where YourNZDriver needs to secure:

  • accommodation;
  • attraction or activity tickets;
  • ferry reservations;
  • guides;
  • specialist vehicles;
  • subcontracted transport;
  • driver accommodation or flights;
  • vehicle relocation;
  • event reservations;
  • restaurant or venue deposits; or
  • other Supplier commitments.

The amount required will be stated in your Booking Confirmation.

6.4 Protecting Supplier commitments

YOURNZDRIVER LIMITED is not required to advance its own funds on behalf of a client in order to secure Supplier Services.

If Supplier payments or other booking commitments will exceed the amount we currently hold for your booking, we may require an additional payment before making those commitments.

This payment may be required even if the ordinary final-balance date has not yet been reached.

6.5 Final payment

The remaining balance must be paid by the date specified in your Booking Confirmation.

Bookings made close to the commencement date may require full payment at confirmation.

We are not required to commence or continue Services where required payments remain overdue.

6.6 Card payments

Where applicable, a 2% payment-processing surcharge applies to eligible card payments where that surcharge:

  • has been disclosed before payment; and
  • is permitted by applicable law.

No surcharge will be imposed where the law prohibits one.

This wording is intentionally narrower than simply saying “all credit cards attract 2%”, given New Zealand's changes around in-store merchant surcharging. The legislative framework has specifically targeted in-store EFTPOS, Visa and Mastercard surcharges while treating online payments differently.

6.7 Changes to the Booking Price

Additional charges may apply where:

  • you request additional time or Services;
  • passenger or luggage requirements change;
  • extra vehicles become necessary;
  • the route or itinerary is changed at your request;
  • additional waiting occurs;
  • additional parking, ferry, access or similar costs arise because of the booking;
  • a Supplier Service requested by you increases in cost before it is secured; or
  • another additional cost is reasonably incurred because of a change to the confirmed booking.

We will advise you of material additional costs where reasonably practicable.


7. Waiting Time and Additional Vehicle Time

7.1 General waiting time

The waiting or grace period included with a booking depends on the Service and will normally be stated in the Booking Confirmation.

Where the driver or vehicle must remain available beyond the included period, additional waiting may be charged.

Waiting charges do not guarantee indefinite availability.

Drivers may have subsequent bookings and are also subject to legal and safety restrictions.

7.2 Airport arrivals

International arrivals

Unless otherwise stated in your Booking Confirmation:

  • the driver will normally enter the meeting area approximately 30 minutes after actual flight arrival;
  • up to 120 minutes from actual flight arrival is included for airport processing and passenger collection; and
  • additional waiting beyond the included period is charged at NZD $20 per 10 minutes or part thereof.

Domestic arrivals

Unless otherwise stated:

  • the driver will normally enter the meeting area approximately 10 minutes after actual arrival;
  • up to 45 minutes from actual arrival is included; and
  • additional waiting is NZD $20 per 10 minutes or part thereof.

Airport departures

A grace period of 15 minutes after the confirmed collection time applies.

After that period, additional waiting may be charged at NZD $20 per 10 minutes or part thereof.

7.3 Flight monitoring

Where correct flight information has been provided, we will make reasonable efforts to monitor published flight information.

We cannot guarantee immediate availability where a flight arrives substantially earlier than scheduled.

7.4 Additional costs

Additional driver or vehicle time, parking, airport charges, port charges, tolls, access charges, Supplier charges and similar costs reasonably arising from a client's delay or change may be charged to the Booking Client.


8. Cancellations and Refunds

8.1 How this cancellation policy works

When a booking is confirmed, YourNZDriver reserves driver, vehicle and operational capacity for that client and may decline other work.

For larger journeys we may also make substantial financial commitments to Suppliers.

Cancellation charges are intended to reasonably compensate YourNZDriver for booking-specific loss and commitments. They are not intended to operate as a penalty.

Any percentage stated below is the maximum cancellation charge for the relevant YourNZDriver Service, subject to:

  • the loss reasonably associated with the cancellation;
  • Supplier and committed costs;
  • capacity reserved for the client;
  • work reasonably declined because that capacity was reserved;
  • whether replacement work can reasonably be obtained;
  • costs avoided because of cancellation; and
  • rights which cannot lawfully be excluded.

8.2 Third-party and committed costs come first

Regardless of the cancellation period, the client remains responsible for booking-specific costs that YourNZDriver has reasonably paid, committed or become liable for and cannot reasonably recover.

These may include:

  • accommodation;
  • attraction or activity tickets;
  • driver accommodation;
  • driver flights;
  • ferries;
  • specialist guides;
  • additional vehicles;
  • vehicle positioning or relocation;
  • venue or restaurant deposits;
  • event costs; and
  • other Supplier commitments.

Where a Supplier cost is partly refundable, only the unrecovered portion will remain payable.

Where YourNZDriver later recovers an amount previously treated as non-refundable, the recovered amount will be passed back to the client where appropriate.

A cost will not be charged twice.

8.3 Standard Airport and Point-to-Point Transfers

Unless the transfer forms part of a Major Booking:

More than 72 hours before pickup:

Amounts paid will be refunded, less any earned Planning Fee and unrecoverable Supplier or committed costs.

Between 24 and 72 hours:

A cancellation charge of up to 50% of the affected Service Price may apply, plus unrecoverable Supplier or committed costs.

Less than 24 hours:

A cancellation charge of up to 100% of the affected Service Price may apply.

No-show:

Up to 100% of the affected Service Price may be payable.

8.4 Private Day Tours, Chauffeur and Hourly Charter

Unless classified as a Major Booking:

More than 7 days before commencement:

Amounts paid will ordinarily be refundable, less earned Planning Fees and unrecoverable Supplier or committed costs.

Between 72 hours and 7 days:

A cancellation charge of up to 50% may apply.

Less than 72 hours:

A cancellation charge of up to 100% may apply.

No-show:

Up to 100% may be payable.


9. Major, Multi-Day and Multi-Service Bookings

9.1 What is a Major Booking?

A booking may be classified as a Major Booking where one or more of the following applies:

  • the related booking is NZD $1,500 or more;
  • multiple Services form one itinerary;
  • Services operate across several days;
  • a driver or vehicle is reserved for an extended period;
  • substantial driver or vehicle positioning is required;
  • specialist vehicles or drivers are required;
  • driver accommodation or travel is required;
  • it involves a wedding, conference, delegation, major event, cruise group or significant passenger movement;
  • the booking falls within an identified peak-demand period; or
  • the Booking Confirmation expressly identifies it as a Major Booking.

9.2 Default cancellation schedule for Major Bookings

Unless different booking-specific conditions were disclosed before confirmation:

More than 90 days before the first affected Service:

A cancellation charge of up to 20% of the affected YourNZDriver Service component may apply.

61–90 days:

Up to 30% may apply.

31–60 days:

Up to 50% may apply.

15–30 days:

Up to 75% may apply.

14 days or less:

Up to 100% may apply.

No-show or cancellation after commencement:

Up to 100% of the affected remaining Services may apply.

In every case, unrecoverable Supplier and committed costs remain payable in addition, but costs will not be counted twice.

9.3 Booking-specific cancellation terms

A particularly high-value, complex, bespoke, multi-day or peak-period booking may require different cancellation and payment conditions.

Those conditions may be more protective than the standard schedule where reasonably required by the financial or operational commitments involved.

They must be disclosed before the booking is confirmed.

9.4 Cancellation liability is not limited to money already paid

The amount a client is responsible for following cancellation is not automatically limited to the Initial Booking Payment already held.

If the proper cancellation charge and unrecoverable committed costs exceed the amount already paid, the Booking Client may be invoiced for the reasonable shortfall.

If the amount held exceeds the final cancellation liability, the remaining refundable balance will be returned.

9.5 Supplier refunds

Where a refund depends upon YourNZDriver recovering money from a third-party Supplier, we are not required to fund that Supplier's refund from our own money while awaiting recovery, except where applicable law requires otherwise.

Any amount recovered will be passed on appropriately once received.


10. Partial Cancellation or Itinerary Changes

Cancelling one part of an itinerary does not automatically cancel the rest.

However, removing or changing one part of a journey may affect:

  • vehicle allocation;
  • driver allocation;
  • driver accommodation;
  • positioning;
  • ferry bookings;
  • Supplier bookings;
  • overall itinerary feasibility; or
  • the basis on which the original price was calculated.

We may therefore need to reprice the remaining journey.

Any revised price will be communicated before the revised arrangements proceed.


11. Flight Disruption and Exceptional Circumstances

11.1 Flight delays

A normal airline delay will not automatically be treated as a passenger cancellation.

We will make reasonable efforts to adjust the collection time where possible.

However, an extended delay may affect the availability of the originally assigned driver or vehicle.

We may, where reasonably practicable:

  • adjust the time;
  • substitute another suitable driver;
  • substitute another suitable vehicle;
  • reschedule the Service; or
  • make another reasonable arrangement.

Additional costs may apply where additional driver, vehicle, parking or Supplier costs are incurred.

11.2 Flight cancellation or diversion

If a flight is cancelled, diverted or materially disrupted, please contact us as soon as reasonably practicable.

We will endeavour to transfer the booking to revised travel arrangements where possible.

A flight cancellation or diversion does not automatically create an entitlement to a full refund where driver, vehicle or Supplier capacity has already been committed.

11.3 Exceptional circumstances

We recognise that serious unforeseen circumstances can occur, including:

  • bereavement;
  • serious illness or injury;
  • hospitalisation;
  • significant travel disruption;
  • natural disaster;
  • severe weather;
  • declared emergency;
  • government travel restrictions; or
  • another serious circumstance materially preventing travel.

Where appropriate, YourNZDriver may consider:

  • rescheduling;
  • transferring payments to new dates;
  • a future credit;
  • reducing a cancellation charge;
  • a partial refund; or
  • a full refund.

This is discretionary and will take account of the circumstances and costs already incurred or committed.

Comprehensive travel insurance remains strongly recommended.


12. Cruise and Shore Excursion Services

Cruise itineraries are particularly vulnerable to weather, port and ship-operational changes.

Where a cruise ship arrives late, we may shorten or modify the excursion while making reasonable efforts to preserve the important parts of the itinerary.

The driver has authority to adjust timing or route where reasonably necessary to protect the scheduled return-to-ship time.

Passengers must follow communicated return times.

Where a passenger delays the group or chooses not to follow a reasonable return instruction, YourNZDriver is not responsible for resulting missed activities, additional transport or missed ship departure except to the extent caused by our own failure to exercise reasonable care and skill.

If a cruise ship cancels a port call entirely, the cancellation provisions in these Terms will apply, including any unrecoverable driver, vehicle or Supplier commitments.

Where costs can reasonably be avoided or recovered, that will be taken into account.


13. Multi-Day Touring, Driver Safety and Operational Changes

13.1 Driver duty and fatigue

Safety takes priority over itinerary convenience.

YourNZDriver generally plans driver duties to a maximum of 12 hours in a duty day, together with appropriate rest periods.

We will not require a driver to operate an itinerary that we reasonably consider unsafe, unlawful or inconsistent with appropriate fatigue management.

For context, NZTA guidance for small passenger service drivers includes statutory limits of 13 hours' work time in a cumulative work day and at least 10 hours' continuous rest; YourNZDriver's 12-hour operating policy is therefore deliberately more conservative.

If a requested itinerary requires additional driver hours, we may require:

  • another driver;
  • an additional overnight stay;
  • a modified itinerary;
  • additional transport; or
  • another safe operating arrangement.

Additional costs will be advised where reasonably practicable.

13.2 Route and itinerary changes

Routes and timings may need to change because of:

  • road closures;
  • weather;
  • traffic;
  • accidents;
  • emergency events;
  • safety concerns;
  • attraction availability;
  • ferry disruption; or
  • circumstances outside our reasonable control.

We will make reasonable efforts to provide a suitable alternative.

13.3 Driver substitution

The driver originally intended for a booking may be replaced where reasonably necessary because of:

  • illness;
  • fatigue;
  • family emergency;
  • vehicle failure;
  • regulatory requirements;
  • operational necessity; or
  • another reasonable cause.

Driver details supplied before travel are therefore subject to change.

13.4 Vehicle substitution

Unless a specific individual vehicle is expressly guaranteed in writing, YourNZDriver may provide a different vehicle of reasonably comparable suitability, passenger capacity and standard where necessary.

Photographs of vehicle types are illustrative of the expected category unless a specific registration or vehicle has been expressly guaranteed.


14. Luggage, Golf Equipment and Personal Belongings

Clients must provide accurate information about passenger numbers and luggage before confirmation.

This includes, where relevant:

  • golf clubs;
  • wheelchairs and mobility devices;
  • skis or sporting equipment;
  • oversized suitcases;
  • bicycles;
  • specialist equipment; and
  • unusually large quantities of baggage.

Where passengers and luggage cannot be safely or legally carried in the confirmed vehicle, an additional or alternative vehicle may be required at additional cost.

Passengers remain responsible for their personal belongings, except to the extent that loss or damage results from a failure by YourNZDriver to exercise reasonable care and skill or liability cannot lawfully be excluded.


15. Children, Accessibility and Special Requirements

Please advise us before confirmation of:

  • children requiring child restraints;
  • passenger ages where relevant;
  • mobility limitations;
  • wheelchairs;
  • walking aids;
  • significant accessibility requirements; and
  • other requirements that may affect vehicle or itinerary suitability.

A particular accessibility feature is only guaranteed where expressly confirmed.

YourNZDriver may refuse to operate transport where the number of passengers, seating arrangement, child-restraint requirements, luggage or mobility equipment cannot be accommodated safely or lawfully.


16. Passenger Conduct, Alcohol, Smoking and Vehicle Care

16.1 Alcohol, Safety, Legal and Insurance Consequences

Alcohol must not be opened or consumed in any YourNZDriver vehicle while passengers are being carried for hire or reward.

Under section 38(1) of the Summary Offences Act 1981, a person commits an offence if, in a vehicle carrying passengers for reward, they:

  • drink intoxicating liquor — s 38(1)(a);
  • supply or offer intoxicating liquor to another person for consumption there — s 38(1)(b); or
  • possess or control intoxicating liquor for the purpose of consuming it there — s 38(1)(c).

The maximum penalty is a fine of up to NZD $300 per person. Section 38(2) expressly provides that a vehicle carrying passengers under charter is deemed to be carrying those passengers for reward.

A breach may result in the journey being terminated immediately, Police being contacted, and the passenger being liable for cleaning, damage or other reasonable costs caused by their conduct. YourNZDriver operates as a commercial passenger transport operator and must comply with applicable law and insurance conditions. Unlawful or prohibited conduct may prejudice, restrict or invalidate insurance cover for an incident or claim, depending on the circumstances and applicable policy terms.

Our drivers cannot waive this prohibition or authorise alcohol consumption onboard under any circumstances.

Sealed alcoholic beverages purchased or carried as luggage may be transported only where:

  • the driver permits it;
  • they can be stored safely and securely; and
  • doing so is lawful.

Where possible, sealed alcohol should be carried in the luggage or cargo area rather than the passenger compartment.

16.2 Drugs, smoking and vaping

Illegal drugs must not be carried or consumed in a vehicle.

Smoking and vaping are strictly prohibited.

16.3 Intoxicated or disruptive passengers

A passenger who has consumed alcohol before travelling may still be carried where their behaviour remains safe and appropriate.

A driver may refuse or terminate transport where a passenger is:

  • excessively intoxicated;
  • abusive, threatening or aggressive;
  • dangerous or irresponsible;
  • seriously distracting the driver;
  • interfering with safe vehicle operation;
  • significantly disrupting other passengers; or
  • reasonably likely to damage or excessively soil the vehicle.

The driver's decision on an immediate safety matter is final.

Where transport is refused or terminated because of passenger conduct or a breach of these Terms, no refund is payable for the affected Service and the Booking Client remains responsible for proper additional costs arising from the incident.

16.4 Vehicle damage

The Booking Client is responsible for reasonable costs arising from deliberate, reckless or negligent damage caused by passengers in their booking.

This can include reasonable:

  • repair;
  • replacement;
  • specialist cleaning; and
  • vehicle loss-of-use costs directly resulting from the damage.

16.5 Cleaning

Where professional cleaning is required because of vomiting, bodily fluids, significant food or drink spills, staining, excessive rubbish or similar passenger-related soiling, a minimum cleaning charge of NZD $250 may apply.

Where actual specialist cleaning, repair or downtime reasonably exceeds NZD $250, the additional reasonable cost may also be charged.

16.6 Food and non-alcoholic drinks

Food and non-alcoholic beverages may only be consumed where permitted by the driver or agreed by YourNZDriver.

Passengers are responsible for resulting damage or excessive cleaning.

16.7 Seatbelts and driver instructions

Passengers must wear seatbelts where required and comply with reasonable driver instructions relating to safety.

Drivers will not carry more passengers than the vehicle can legally accommodate.


17. Right to Refuse or Terminate Transport

YourNZDriver or the assigned driver may refuse to commence or continue transport where doing so would reasonably:

  • compromise passenger, driver or public safety;
  • involve unlawful activity;
  • expose the vehicle to unreasonable risk;
  • involve abusive, threatening or seriously disruptive conduct;
  • breach vehicle capacity restrictions; or
  • require the driver to operate contrary to legal, regulatory or reasonable safety requirements.

Where the refusal results from passenger behaviour or a breach of these Terms, the affected Service remains payable and reasonable additional costs may also be charged.


18. Travel Insurance

We strongly recommend comprehensive travel insurance, particularly for:

  • international visitors;
  • multi-day journeys;
  • high-value bookings;
  • cruises;
  • bespoke tours;
  • bookings involving accommodation or attraction reservations; and
  • journeys involving substantial Supplier commitments.

Insurance should be considered for cancellation, illness, bereavement, delay, natural disaster, medical emergency and travel disruption.

Our compassionate consideration of exceptional circumstances is not a substitute for travel insurance.


19. Passports, Visas and Travel Documents

Travellers are responsible for ensuring that they hold any passport, visa, entry document, permit or other documentation required for their travel.

YourNZDriver is not responsible for a traveller's inability to participate in a Service because the traveller does not hold required documentation, except where responsibility cannot lawfully be excluded.


20. Privacy

YourNZDriver may collect passenger information necessary to plan and provide Services.

This may include:

  • names;
  • contact information;
  • flight details;
  • accommodation details;
  • itinerary information;
  • luggage information;
  • accessibility information; and
  • other information reasonably required to deliver the booking.

We may provide relevant information to drivers, Suppliers or service providers where reasonably necessary to provide the booking.

Our handling of personal information is also governed by our Privacy Policy and New Zealand privacy law.

Where information is supplied to us by a travel agent, company, family member or another person rather than directly by the traveller, we may take reasonable steps to notify the traveller about the collection and use of that information where required.

This is now particularly important because New Zealand's IPP3A has applied since 1 May 2026 to indirect collection of personal information.


21. Liability and Consumer Rights

21.1 Your statutory rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under:

  • the Consumer Guarantees Act 1993;
  • the Fair Trading Act 1986;
  • the Contract and Commercial Law Act 2017; or
  • other applicable New Zealand law.

21.2 Services provided by YourNZDriver

Where applicable law requires it, YourNZDriver will provide its Services with reasonable care and skill.

21.3 Independent Supplier Services

Where we act solely as agent or coordinator for an independent Supplier, we are not responsible for that Supplier's independent acts or omissions, although we remain responsible for exercising reasonable care and skill in carrying out our own role.

21.4 Events beyond our reasonable control

Subject to rights which cannot lawfully be excluded, YourNZDriver is not responsible for loss caused solely by events outside our reasonable control, including:

  • serious weather;
  • natural disaster;
  • road closure;
  • major traffic disruption;
  • government action;
  • port or airport disruption;
  • ferry or airline cancellation;
  • emergency;
  • civil disturbance; or
  • another comparable event outside our reasonable control.

We will nevertheless make reasonable efforts to assist with practical alternatives where possible.

21.5 Business-to-business bookings

Where:

  • both parties are in trade;
  • the Services are supplied and acquired in trade;
  • the agreement is in writing;
  • the parties agree to contract out; and
  • it is fair and reasonable that they do so,

the parties agree that the Consumer Guarantees Act 1993 will not apply to the extent permitted by section 43 of that Act.

This clause does not apply where those statutory requirements are not satisfied.


22. Confidentiality

Information genuinely confidential to either party should be treated as confidential.

This does not include:

  • these publicly available Terms;
  • information already lawfully in the public domain;
  • information required to deliver the booking;
  • information lawfully disclosed to drivers or Suppliers;
  • information disclosed to lawyers, accountants, insurers or professional advisers; or
  • information required to be disclosed by law.

23. Changes to These Terms

The version of these Terms applying to a booking is ordinarily the version made available when that booking is confirmed.

Updating our website Terms later does not retrospectively impose more restrictive conditions on an existing confirmed booking unless:

  • the parties agree; or
  • a change is required by law.

24. Notices and Cancellations

A cancellation must be provided to YourNZDriver in writing.

Email or another written communication method accepted by us is sufficient.

Cancellation is effective when received by YourNZDriver.

Cancellation periods are calculated using New Zealand local time at the location where the affected Service is due to commence.


25. General

If any part of these Terms is found to be invalid or unenforceable, the remaining Terms continue to apply to the extent permitted by law.

A failure by YourNZDriver to enforce a right on one occasion does not automatically waive that right on another occasion.

These Terms and the Booking Confirmation form the entire agreement relating to the confirmed Services, together with any applicable booking-specific or Supplier conditions expressly incorporated into the booking.

These Terms are governed by New Zealand law.

The parties submit to the jurisdiction of the New Zealand courts.
